These Terms and Conditions ("Terms") govern your access to and use of the MailGovern platform, APIs, Add-ins, and associated services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Account Registration

To access our Services, you must register for an account. You agree to provide accurate, current, and complete information and to keep this information up to date. You are solely responsible for safeguarding the password and API keys associated with your account.

2. Enterprise API Usage

Our Services heavily rely on background sync operations via the Microsoft Graph API, Exchange Web Services (EWS), and Google Workspace APIs.

Rate Limits: You must not systematically attempt to subvert our API rate limits or the rate limits imposed by the underlying providers (Microsoft/Google).
Tenant Authorization: You represent and warrant that you hold the necessary administrative rights to grant MailGovern access to the target Exchange or Google Workspace tenants.

3. Acceptable Use Policy

You agree not to use the Services to:

Transmit spam, malware, or any other malicious payloads.
Violate any applicable laws, regulations, or third-party rights, including privacy rights and intellectual property rights.
Reverse engineer, decompile, or otherwise attempt to extract the source code of the MailGovern platform.

4. Intellectual Property

All rights, title, and interest in and to the Services (excluding data provided by you) are and will remain the exclusive property of MailGovern and its licensors. Our branding, logos, and software architectures are protected by copyright and trademark laws.

5. Limitation of Liability

To the maximum extent permitted by applicable law, MailGovern shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services.

6. Service Level Agreement (SLA)

Enterprise customers are subject to the specific uptime guarantees and support response times delineated in their Master Service Agreement (MSA). For standard accounts, we provide the Services on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind.

7. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, if we believe you have breached these Terms.
